All live auctions will be conducted in accordance with "the terms and conditions" incorporated herein by reference, and copies of which will be posted on the premises.
By tendering a bid at the public auction sale, the bidder acknowledges and agrees to be bound by the auctioneer's terms and conditions of the sale.
Bidder must register with auctioneer to participate in the auction.
Complete payment must be made on day of auction. Cash, cashier's check, money order, or other certified instrument is preferred. Personal or company checks will be accepted up to $3,000.00 if accompanied by a valid driver's license. All checks and all checks over $3,000.00 must be accompanied by an irrevocable letter of payment guarantee from bidder's bank. All checks are verified electronically by Global Payments. Credit cards (Mastercard, Visa, Discover, & American Express) and Debit cards may or may not be accepted at certain auctions, call auctioneer in advance of sale for information. Purchase Orders accepted from government and pre-approved corporate customers only, terms net 10 days. Wire transfer deposits will be accepted as deposits only if received by Shattuck & Associates prior to auction sale. Non- U.S. Funds will be accepted at the rate of exchange as published in the previous day's Wall Street Journal. A handling charge of 10% of the invoice total will be incurred when payment is made in foreign currency.
For any purchase paid in cash with a value of $10,000.00 or greater, the buyer is required to complete United States Treasury Department Form No. 8300. These forms are available from the auctioneer and must be completed and returned to the auctioneer at time of purchase.
The requirement to pay sales tax is governed by state law. Sales tax will be added to buyer's purchase total unless a valid sales tax use/resale or exemption certificate number is furnished at time of payout.
A buyer's premium may be in effect at any auction. Inquire with auctioneers for specific sale terms.
All auction merchandise is sold "AS IS-WHERE IS" with all faults. There are no warranties made either by the owner of the auctioneer that any of the property is merchantable or fit for use for any particular purpose.
Pronouncement of the name of the buyer, the number of the buyer, or the word "SOLD" shall be final.
In the event of a dispute among bidders, the auctioneer shall make the sole and final decision to either accept what he deems as the final bid or to reoffer and resell the item(s) in dispute. In case of tie bids the auctioneer will reopen the bidding.
Some items may be auctioned with reserve, subject to seller's right of confirmation.
Equipment must be removed from the auction by hour and date stated by the auctioneer orally and in print for each auction. All removal is at the complete risk and expense of the bidder. Neither the seller or auctioneer provide personnel for loading. Merchandise becomes the full responsibility of the bidder once he is declared the buyer. Buyer assumes all responsiblity fo loss and damage of purchased merchandise. Neither the auctioneer of the seller shall be responsible for buyer's merchandise. Please note that removal deadlines are strictly enforced! Merchandise not removed by the stated date and hour will revert to seller's possession, with all rights and title to the equipment forfeited.
It is the buyer's responsibility to secure all safety equipment to meet applicable government safety standards in using or removing items purchased. Certain pieces of equipment may contain residual chemicals. The purchasers hereby indemnify and hold harmless the auctioneers and sellers from any and all damages, claims, or liabilities from any injuries to persons or property caused during the sale or during use or operation of the purchased items.
The information and descriptions contained in the sales advertisements are believed to be true and correct. The auctioneer and/or seller assume no responsibility and make no warranties regarding same. It is the buyer's responsibility and obligation to verify information and descriptions of property prior to sale.
All announcements made on auction day shall take precedence over previously distributed material.
No re-selling, trading, etc., of merchandise is permitted at the auction site.
Smoking is prohibited in auction facilities.
"Distressed medical devices" for auction in the State of Texas will be sold as mandated by Texas law.
Chemical laboratory apparatus for auction in the State of Texas will be sold as mandated by Texas law..
All oral statements made at auction supercede written statements.
